Protect or Surrender: Attorney-Client Privilege During Investigations

The ethical duty to protect clients’ privileged information is generally well known and understood among attorneys. However, this duty in the context of investigations into allegations of misconduct or regulatory violations present particular challenges and occasion for critical questions. As counsel, how do you distinguish between the information that should be preserved versus information that may be surrendered? How do you interact with law enforcement agencies who seek disclosure of information they've acquired during such internal inquires?

The MSBA Health Law Section and the Hamline Health Law Institute are pleased to welcome Donald M.
