David Allen Larson, professor in the Hamline School of Law, is one of the two parties whose request to file a brief amicus curiae ('friend of the court') on behalf of appellant Western Digital Corporation was granted by the Minnesota Supreme Court in the case of SeagateTechnology, LLC. v. Western Digital Corporation, Western Digital Technologies, Inc., and Sining Mao.
The appellant is attempting to vacate an arbitrator's award that now exceeds $600 million. The case involves unsettled and nationally significant issues concerning arbitrators' authority, the "legalization" of arbitration, the meaning of the Federal Arbitration Act, and access to justice. The case is scheduled for oral argument before the Minnesota Supreme Court on February 5, 2014 at 9 a.m. at the Minnesota State Capitol.
